New homes in Spain must comply with the current Technical Building Code (CTE), which sets demanding requirements for insulation, energy efficiency, acoustics and safety. 2. Legal guarantees for the buyer
Spanish law (Ley de Ordenación de la Edificación) protects buyers of new builds with a 10-year guarantee for structural defects, 3 years for habitability issues and 1 year for finishing defects. In addition, payments made to the developer before completion must be secured by a bank guarantee or insurance, so your deposits are protected.
3. Staged payments and time to plan
When you buy off-plan, the price is usually paid in instalments during construction, with the largest part due at completion. This gives investors time to organise financing, sell another property or simply spread the investment over 18–30 months.

What to keep in mind
Every development is different. Before signing, check the developer’s track record, the building licence, the bank guarantee for your payments, the quality specifications and the expected completion date. Taxes also differ from resale purchases: new builds pay VAT (IVA) and stamp duty (AJD) instead of transfer tax (ITP).
